Please read the terms and conditions displayed before using the brazilianbabe.com.au website. By using the brazilianbabe.com.au website, you are deemed to have read the terms and conditions and be bound by them.

This website has been developed for use by customers and intended customers. You agree not to use the website in any way that causes or is intended to cause access or the website to be damaged, interrupted, or impaired in anyway including but not limited to:

• Causing annoyance or nuisance inconvenience or mischief
• Fraudulent purposes or in connection with unlawful or criminal activity
• Breach of copyright, trademarks, confidence, privacy or any other right by Brazilianbabe

When you place an order to purchase a product from Brazilianbabe, we will send you an email confirming receipt and details of your order. Our acceptance of this offer to purchase will be at the time we dispatch that product to you and a confirming email in this regard is sent. The acceptance will be complete at this time. It is agreed at the time you place an order it is your intention to enter into a contract with Brazilianbabe.

Australia prices are shown in AUD and will be charged in AUD.

Brazilianbabe list products for sale on its website as indicated. Whilst we use our best endeavours to fulfil such orders, we cannot be held responsible if the products are not available at a given point in time. It is further noted that dispatch times indicated below are a guide and are not guaranteed dispatch times and should not be relied upon as such.

CONSENT

Brazilianbabe.com.au assumes all sales are made to persons over the age of 18. If you are under 18, you need to have the involvement of a parent or guardian.

Payment is only accepted by means of the credit card types as shown and PayPal. We are unable to process any other payment form.

We reserve the right to make changes to our website, policies, terms and conditions at any time.

Should you breach any terms or conditions, and we take no action against you, we shall be entitled to invoke our rights and remedies in any other situation where you breach these conditions.

The above terms and conditions are governed by the laws applicable of the state of New South Wales in Australia. Both parties submit to the non exclusive jurisdiction of the New South Wales Courts.

1.1.    To the extent permitted by law, these Terms of Use contain the full set of conditions governing the purchase, issue, redemption and use of your Brazilianbabe Gift Card. Any recipient of the Gift Card should be directed to these Terms of Use to ensure that they are appropriately informed before they make use of their Gift Card.

1.2.     Customer service or any Brazilianbabe team members are unable to apply the voucher to an order that has already been processed.

By purchasing, redeeming, attempting to redeem or otherwise using a Gift Card, you accept and agree to be bound by these Terms of Use.

Purchasing the Gift Card

2.1.    Gift Cards may be purchased online and at participating Brazilianbabe Market Stalls.

2.2.    The initial value deposited to the account of the Gift Card is determined as at the time of purchase, in local currency and no further amounts may be deposited following purchase.

2.3.    Gift Cards may not be cancelled once payment has been processed.  Gift Cards are not (in part or in full) refundable or redeemable for cash.

3. Purchases using the Gift Card

3.1.    Your Gift Card may only be used to make purchases up to the value contained on the Gift Card. If you wish to make a purchase of goods for an amount that exceeds the value on your Gift Card, you must pay the excess using another payment method.

3.2.    No change will be given where any value or credit balance remains on the Gift Card following a purchase of goods.

3.3.    Your Gift Card cannot be used to purchase another Gift Card.

3.4.    You must spend a minimum of AUD$50 in order to use your Gift Card to purchase a Brazilianbabe product.

3.5     Customer service or any Brazilianbabe team members are unable to apply the voucher to an order that has already been processed.

You cannot obtain any cash advance with your Gift Card.

5.1.    Your Gift Card will be valid for 3 years from the date of purchase. The value of any unused balance on the Gift Card after the date of expiry will be forfeited and will not be refunded, credited or transferred to any replacement or new Gift Card.  It is your responsibility to ensure the value placed on the Gift Card is redeemed within that time frame.

5.2.    You can confirm the expiry date and balance of your Brazilianbabe Gift Card and your transaction history via email at infobrazilianbabe@gmail.com

6.1.    Brazilianbabe accepts no responsibility for the loss, theft or destruction of Brazilianbabe Gift Cards and Brazilianbae has no obligation to replace or refund the value of lost, stolen or damaged Gift Cards.

6.2.    You are liable for all transactions on your brazilianbabe Gift Card, including where your Gift Card has been lost or stolen.

6.3.    Brazilianbabe is entitled to prevent further use or the redemption of the value contained on any Gift Card if:
(a)         you report that it has been lost, stolen or damaged; or
(b)        Brazilianbabe believes or has reason to suspect that the Gift Card has been or will be used in a manner that contravenes these Terms of Use or is unlawful, misleading or deceptive, unfair or causes detriment to any other person.

Brazilianbabe reserves the right to change any of the terms contained in these Terms of Use.

9.1.        These Terms of Use are to be construed and enforced in accordance with the laws of New South Wales, Australia. Any dispute arising from your receipt or use of a Gift Card is exclusively subject to the jurisdiction of the courts of New South Wales, Australia (including the Federal Court of Australia). 

Brazilianbabe values your privacy

Brazilianbabe keeps confidential all personally identifiable information you provide us.

If you register your details with us, or order a catalogue, your information allows us to communicate with you about our products, promotions and activities.

The information that you provide us through our website will be used to update our customer database. This information is for Brazilianbabe’s internal use only, and is used for the purpose of customer communication.

If you purchase any of your products online, we will also use the information you provide us to process your order and its delivery to you.

We like to know that the personal information you provide us is accurate, complete and up to date. If you notice that your personal information is missing or incorrect, you can contact us at infobrazilianbabe@gmail.com.

So that we can continue to offer you great offers and promotion info, we give you the opportunity to say yes to being contacted by Brazilianbabe. If you would like your name deleted from the database please email infobrazilianbabe@gmail.com requesting deletion. You will be deleted from our database within 48 hours.

We ensure that any personal information we no longer need is either destroyed or that you become permanently unidentifiable from the information.

Brazilianbabe asserts copyright and all other intellectual rights in relation to the content of this Internet site and code used to create it, unless stated otherwise.

Brazilianbabe also reserves copyright and all other intellectual property rights in relation to all of its documents and images appearing on or linked to this web site. Users of this website may download a single copy of these documents or images for their personal use only.

• Typical delivery time frame is 1-5 business Days (please allow extra time during sale periods)
• All orders are dispatched with Australia Post and DHL Australia
• Shipping charges are non-refundable
• We give authority to leave parcels – if this will cause inconvenience, we suggest sending the item to a business address.

• We accept returns for change of mind, size changes and style changes in exchange for a store credit. We do not offer refunds unless an item arrives faulty or damaged.
• All items in our SALE section are final sale, they will not be restocked and can not be returned.
• You have 30 days from the date you placed your order, to lodge a return request. The item must be returned in its original condition, unworn, unwashed, unsoiled, with tags and the hygiene liner still attached, no odours (including perfumes). If these conditions are not met, the return will be rejected and returned to you again at your own expense.
• Please note that it is the customer’s responsibility to pay for all shipping costs when returning their item/s. Once your return has been lodged in our portal, you will receive an email directing you to pay for your return. This return label can then be printed and attached to your parcel for you to either:

1. Drop at your local post office
2. Drop at your local post box
3. Leave with a mail carrier

• Please allow up to 3 business days from when your return is received at our warehouse for your store credit to be issued. Brazilianbabe is not responsible for any lost or damage items when returning.
• All items in our SALE section are final sale, they will not be restocked and can not be returned.
• If you purchase your item during a storewide discount or sales promotion period and would like to return your item, we will provide you with a store credit of the amount paid at the time of purchase. If an item is purchased during a sales promotion period and is returned for a credit, any replacement items will need to be re-purchased at the value they are listed for on our site at the time of re-purchase.
  

Brazilianbabe reserves the right to retract any promotion/competition at any time.
